1. Scope / Terms

1.1. For the legal relationship formed between the Internet shop operator (hereinafter called “Provider”) and its customers, only the following terms and conditions apply in respective version at the time of the order. Different terms and conditions of the customers will be rejected.

The following terms and conditions apply only if we become aware of contrary or divergent conditions of the customer and delivery and service may be cancelled without reservation.


2. Customer account

2.1. In order to conclude a contract with us, every customer must create a password account on our website. This enables you to provide your address, bank details necessary for sending you the ordered goods, to view your current and past orders, recently shipped orders and also to receive a newsletter from our online shop. 2.2. An account can be created only by a legally competent person. As a prerequisite, all required information provided by the customer in the registration form must be true. 

The customer has the obligation to inform immediately on any change in the details requested during registration when next using our online shop. 

2.3. If a customer provides false information at registration or fails to modify his/her contact details when changed, the customer may be immediately banned access to our online shop.

2.4. The customer is solely responsible for the security of their password. Disclosure to third parties is prohibited. If the password has become known to unauthorized persons, the customer is required to change their password immediately.


3. Formation of contract

3.1. Your contractor is the BeltArt accessories GmbH (Seller)

3.2. Contracts in our online shop can be closed only in German language and governed by the laws of the Federal Republic of Germany.

3.3. The presentation of goods on the internet shop is not a binding offer by the supplier to conclude a contract of sales, the Customer shall only invited to submit an order to an offer.

3.4. By sending the order via the Internet shop, the customer makes a binding offer directed at the conclusion of a sale of the goods contained in the basket. By sending the order, the customer accepts these terms and conditions as the the only legal relationship with the provider that prevail.

3.5. The vendor shall acknowledge receipt of the customer's order by sending a confirmation e-mail. This confirmation is not yet an acceptance of the contract offer made by the customer.

It serves only to inform the customer that the order is received by the provider. The declaration of acceptance of the offer is made by delivering the goods or an explicit declaration of acceptance.

Subject to an already existing right of widthdrawal for orders as a consumer, the customer is bound to his order for goods marked as available for 2 working days. Furthermore there is a binding of maximum 4 working days.

 3.6. The delivery of the ordered goods will be made only after the full amount for the customer’s order will be received into our account.


4. Price and shipping

4.1. For orders made in our online shop, the applied price will be the one listed in the price offer valid at the time of the customer’s order. The stated prices are final, that is, they contain the valid German VAT and other price components.


5. Payment, delivery

5.1. For purchases made in our online shop, the accept payment by card transfer, credit card and Paypal. Your credit card account will be changed with the value of the customer’s order. Please note that we accept payments only from accounts inside the European Union (EU). We do not accept money transaction charges from non-EU Member States.

5.2. For deliveries within Germany, we use UPS exclusively. For other shipping requests, please contact us immediatelyafter receiving the confirmation email.

5.3. For the goods that are marked on our internet shop as “Available/In stock”, we will provide a confirmation email by the end of the next business day since the order was received. For any different delivery times, we will specify the details on the product page.

5.4. The purchasing risk is not borne by us. We are only obliged to deliver goods from our store.

5.5. If the goods are not available, we will refund a potential pre-payment.

5.6. If the delivery time is extended due to force majeure or by reason of which we are responsible, the customer is entitled to withdraw from the contract. Further claims, especially for damages will not be considered in this case.


6. Cancellation

6.1. The right of withdrawal is in accordance. § 312 d Abs 4 BGB goods e.g. open cosmetic products. For more information, please see the instructions for the cancellation.


7. Reservation of proprietary rights

7.1. The delivered goods remain the property of Beltart Accessories GMBH until full payment was received from the customer.


8.Conditions for redemption of vouchers

8.1. Vouchers can be redeemed in our online shop and are not remunerated in cash or refunded, not even partially. When returning goods paid for with vouchers, no refund will be made in cash.

8.2. Vouchers can be redeemed in several parts and / or be used as partial payment for an order.


9. Warranty and disclaimer

9.1. The statutory warranty regulations.

9.2. Damage claims by the customer are excluded unless otherwise specified below.The above disclaimer also applies to the legal representatives and agents of the provider, if the customer claims against these claims.

Are excluded from liability claims for damages because of injury to life, limb, health, and claims for damages from the breach of contract. Essential contractual obligations are those whose performance to achieve the objective of the contract are necessary: e.g. the provider has given the customer the item free of material defects and deficiencies and transfer the property to the client.

From the disclaimer is also excluded the liability for damage caused by an intentional or grossly negligent breach of duty of the provider, his legal representatives or agents.

9.3. Provisions of the Product Liability Act (Liability Act) remain unaffected.


10. Governing law and jurisdiction

10.1. The contractual relationship between the supplier and the customer will be established under the law of the Federal Republic of Germany.

Excluded from this applicable law are the mandatory consumer protection provisions of the country where the customer has his habitual residence.

The application of the UN purchasing law is excluded.

10.2. The place of jurisdiction for all disputes arising from the contractual relationship between the customer and the provider is the headquarters of the provider, if the customer is a businessman, a legal entity under public law or a public sector fund.


11. Severability clause

11.1. If any provision of the contract in whole or in part be or become invalid, the validity of the remaining provisions or parts of such provitions remains unaffected. The invalid provisions are replaced by the respective legal regulations. This also applies to the of case possible lack of provisions
